		<description>Victor, even if your interpretation is correct -- that Medicare will pay for counseling only if all areas are covered -- what&#039;s wrong with that? Isn&#039;t that kind of like saying the feds will pay school districts for sex education but only if a discussion of abstinence is included?</description>

		<description>It&#039;s regulatory jargon and I have to disagree with Michael Pahre.  This section is ADDED and defines(hhh(4) what is meant with &quot;Advanced Care.  When you use the word &quot;shall&quot; in a regulatory document then all these things are required to be covered.  So if Grandma wants to JUST talk about a living will, Medicare will gladly pay for it as long and ONLY if all the areas are covered - including end of life, DNR&#039;s and rest of list.  Changing the word &quot;shall&quot; to &quot;can&quot; or &quot;may&quot; would completly fix this situation.

I do agree though that this is not manditory counseling but again if Grandma wants to only talk about one aspect then only way medicare will pay for it is if all the items are covered.</description>

		<description>I continue to be amazed at the callers who actually ask Jay for his advice, prediction, etc. as if they have no other way of figuring things out on their own-  it is another indication that most people are not searching for truth, but rather vindication.</description>

		<description>I think that theirs is incompetence of quickly glancing at this text while not reading it in full.

They are probably misinterpreting &quot;Such consultation shall include the following...&quot; as meaning that the consultation is &lt;i&gt;required&lt;/i&gt;.

If they would read the original text in the bill that this clause is modifying, they would find out that it is about the plan covering the cost of such a consultation once every five years, not requiring the consultation.</description>
